At this stage Brightspark Financial Software is not processing
credit card payments over the internet.
All credit card payments can be made by calling 1300 308 248.
We are required to maintain your credit card details for a number of months so that the National
Australia Bank can audit transactions. These details are maintained off line and cannot be
obtained over the internet.
Personal details are maintained for support purposes only and will not be sold
to or provided to any other parties except where required by a court of law.
CONSUMER RIGHTS: The following warranties and rights are provided by
Brightspark Financial Software in addition to any rights that you may have under
the Trade Practices Act and similar state and territory laws.
LIMITED WARRANTY: Brightspark Financial Software warrants that:
a) the SOFTWARE PRODUCT will perform substantially in accordance with the accompanying written
materials for a period of 90 days from the date of receipt; and
b) it will make commercially reasonable efforts to resolve any problem issues.
CUSTOMER REMEDIES: To the maximum extent permitted under applicable law,
Brightspark and its suppliers’ entire liability and your exclusive remedy
under this warranty is, at Brightspark’s option, either (a) return of the price paid,
if any; or (b) repair or replacement of the SOFTWARE PRODUCT which
does not meet this warranty and which is returned to Brightspark with a copy of
your receipt. This warranty is void if failure of the SOFTWARE PRODUCT has resulted
from accident, abuse or misapplication. Any replacement
SOFTWARE PRODUCT will be warranted for the remainder of the original warranty period or 30 days,
whichever is longer.
LIMITATION OF LIABILITY: To the maximum extent
permitted by applicable law, Brightspark and its suppliers disclaim all other
warranties and conditions, either express or implied, including, but
not limited to, implied warranties of merchantability, fitness for a particular
purpose, title, and non-infringement, with regard to the SOFTWARE PRODUCT, and
the provision of or failure to provide support services.
EXCLUSION OF LIABILITY / DAMAGES: The following is without
prejudice to any rights you may have at law which cannot legally be excluded or restricted.
You acknowledge that no promise, representation, warranty or undertaken has been made
or given by Brightspark (or its suppliers) or by any person or company on their behalf
in relation to the profitability of or any other consequences or benefits to
be obtained from the delivery or use of the SOFTWARE PRODUCT or written materials.
You have relied upon your own skill and judgement in deciding to acquire the
SOFTWARE PRODUCT, any accompanying manual and written materials or support services.
Except as and to the extent provided in this agreement, neither Brightspark nor
its suppliers nor any related company will in any circumstances be liable for any
other damages whatsoever (including, without limitation, damages for loss of
business, business interruption, loss of business information
or other indirect or consequential loss) arising out of the use, or inability
to use, or supply, or non-supply, of the SOFTWARE PRODUCT or any written material
or any support services. Brightspark’s total liability under any
provision of this agreement is in any case limited to the amount actually paid by
you for the SOFTWARE PRODUCT and/or any support services or $5.00.
